Federal jury finds tax protestor guilty

Detroit -- A federal jury today convicted tax protester and author Peter Hendrickson on 10 counts of filing false documents.

Hendrickson, 54, of Commerce Township, author of "Cracking the Code," could face prison when he is sentenced by Chief U.S. District Judge Gerald E. Rosen on Feb. 9. Each count is a three-year felony.

Hendrickson's trial began last Tuesday on charges he falsely reported zero or nominal income on his 2000 to 2006 tax returns when he actually earned tens of thousands of dollars each year.

Testifying in his own defense, Hendrickson told jurors that income tax is an excise tax and excise taxes may only be levied upon those who benefit from a government privilege such as a government job.

But the government called expert witnesses from the Internal Revenue Service who rejected Hendrickson's arguments.

The jury deliberated less than half a day.

Hendrickson, who was comforted by his wife Doreen and other family members following the verdict, said he plans to appeal.

He criticized Rosen for instructing the jurors on what the law said, rather than giving them copies of the relevant statutes to read for themselves.

"He relieved the prosecution of its burden in this case," Hendrickson said of the judge.

In 2007, U.S. District Judge Nancy G. Edmunds permanently barred Hendrickson and his wife from filing tax returns on which they falsely reported their incomes as zero. The order came in response to a lawsuit filed against Hendrickson by the U.S. Justice Department. Edmunds found Hendrickson's position on income tax to be "false and frivolous."

Hendrickson, who remains free on bond to await his sentencing, was convicted in 1992, for failing to file a federal income tax return and for a conspiracy involving a fire bomb placed in a bin at a Royal Oak post office.

Hendrickson could face sentencing guidelines of 21 to 27 months on the latest convictions, an official said.

Revenue Restructuring & Reform Act forbids using terms: "tax 
protestor", "tax defier"


In calling Defendant a “tax defier” the representatives of the
United States Department of Justice are engaging in name-calling
and categorizing forbidden to representatives of the United States
Department of Treasury, Internal Revenue Service. See, a portion of
the Internal Revenue Restructuring and Reform Act (Taxpayer Bill of
Rights), Sec. 3707(a), Pub. L. No. 105-206, 112 Stat. 685 (July 22,
1998) which forbids the use of the term “tax protester” or any
similar designation.

Perhaps Mr. Hendrickson should use this in any appeals he may wish to pursue.
If he's been "labeled" as such, there is a case for slander which may make any
previous "convictions" void ab initio.

One cannot enter these "courts" anymore and expect so called "due process", the process has been abolished long ago,the deck is stacked against anyone stupid enough to walk into ANY court room in Amerikka and expect to receive justice  from the JUST-US crowd. Pete stuck his head inside a hornets nest, just sad...

The courts are working fine under the de fecto system people just do not understand how they are operating.

What part of this did pete miss. Smiley Smiley Smiley

                                   “How and why am I liable for income tax?”

To find out the answer, reference section 1 of Title 26 (which imposes the tax); then go to the regulations (Code of Federal Regulations), and one would find the following:

• 26 CFR § 1.1-1(a) General rule. (1) Section 1 of the Code imposes an income tax on the income of every individual who is a ‘citizen’ or ‘resident’ of the United States.”

Who or what is a citizen? Subsection (c) of the same section answers this:
• 26 CFR § 1.1-1(c) Every person born or naturalized in the United States and subject to its jurisdiction is a citizen.

That is language found in the Fourteenth Amendment!, i.e. from the new United States Constitution. This is the key legal term for your journey out of Title 26.

Can't take candy from the bad wolf and not expect to pay it is not going to happen that way so wake the hell up people.

Pete was smart enough to wright a book on the subject and left this out! That just does not add up.

Here is another one that has bit the dust April 23, 2010 like Pete. Smiley

Lindsey Springer another one that did not realise what it means to be a citizen of the U.S.

On April 23, 2010, after a two-day sentencing hearing, Springer was sentenced to 15 years in prison, three years of supervised release following his imprisonment, and ordered to pay $700,000 in restitution. He and co-defendant Oscar Stilley (who received the same sentence) were immediately taken into custody to begin serving their sentences, the judge referring to them as "frauds and predators."

$700,000  ouch cost a whole lot not to know what law you are under. Chump change when you look at changing your nationality the correct way.

Now what was his game Smiley

Springer had failed to exhaust his administrative remedies and the court had no jurisdiction.

Foolish citizen.

Jerry,  Wow. I read the court actions on that Springer guy. What the heck was he smoking? They kept tossing him out of the lion's den and he couldn't get back in there fast enough with one thing or another.
Reminds me of that spin off of  Scooby Doo, Scrappy Doo. He was too small to fight and to stupid to know not to. What did he always say? "Let me at 'em! I'll splat 'em!"

I'll I'd like to say to him is  "Hey Springer....you're doing it wrong! "

but he has decided to give it away for free now. Lord help those souls.

I can't believe someone in jail would not ask the question to himself what was missing in my research.

I guess he needs more friends. Smiley
